The general terms and conditions of Vendior website state what EXALO MEDIA expects from you if you have a personal environment or account on Vendior website, for example with regard to use, liability and privacy on Vendior website.

General part

Article 1 Definitions

  • General Terms and Conditions: the following provisions that apply to the access to and the use of Vendior website.
  • User: the natural or legal person who uses Vendior website.

Article 2 General

By using Vendior website, User agrees to these General Terms and Conditions and the provisions mentioned in the privacy statement on EXALO MEDIA and your privacy.

Dutch law applies to these Terms and Conditions.

Article 3 Purpose and costs

Vendior website consists of, among other things, a resume and vacancy database as well as an informative section in which background information is given on (the functioning of) the labor market.

The use of Vendior website is free.

Article 4 Links to third-party sites

Vendior website contains links and references to websites of third parties. EXALO MEDIA is not responsible for the content of those websites.

Article 5 Use of Vendior website

User will refrain from conduct in violation of these General Terms and Conditions or Dutch laws and regulations.

The User is not allowed to use Vendior website or any part thereof other than the purpose for which it is intended.

User will refrain from conduct that may cause EXALO MEDIA and / or other users damage. This in any case – but not exclusively – means obstructing other Users in the use of Vendior website or hindering the operation of Vendior website.

Article 6 Privacy

The User is aware that Vendior website contains personal data of other Users and will treat the personal data provided to him confidentially.

When using this, User will observe the provisions of the General Data Protection Regulation (AVG) and in the privacy statement on EXALO MEDIA and your privacy.

EXALO MEDIA may make changes to the (access to) the services it offers through Vendior website. EXALO MEDIA will make such changes known to Users in good time.

Article 7 Exclusion

EXALO MEDIA proceeds immediately to the exclusion of the User, if there is a behavior in violation of these General Terms and Conditions or if in another way abuse is made of Vendior website or the facilities offered via Vendior website.

If there is reason to do so, EXALO MEDIA will also inform the Internet service provider of User of the behavior (s) of the User.

Article 8 Maintenance / Faults

EXALO MEDIA endeavors to provide User with uninterrupted access to Vendior website.

EXALO MEDIA can, however, temporarily suspend (parts of) Vendior website without prior notice for the maintenance or elimination of faults. EXALO MEDIA will allow such maintenance work to take place as much as possible at the less frequently used hours.

Article 9 Intellectual property

The intellectual property rights relating to Vendior website, including but not limited to, copyrights to the texts, photos, images, software, design, trademark rights etc. posted by EXALO MEDIA, are held by EXALO MEDIA, unless stated otherwise.

The User is not permitted to edit (copy) texts and hyperlinks of Vendior website, to copy and / or to make available to third parties in any way, unless User has obtained written permission from EXALO MEDIA.

Article 10 Liability

The use of Vendior website by User takes place at own expense and risk. EXALO MEDIA is not liable for the damage, of whatever nature, arising from the availability and / or use of Vendior website, unless there is intent or gross negligence of EXALO MEDIA or its employees.

EXALO MEDIA is not responsible for viruses in an e-mail sent or received by the User.

The information on Vendior website can no longer be complete or accurate at any given time. EXALO MEDIA advises the User to verify the correctness and completeness of the information before taking action.

Article 11 Complaints

You can file a complaint with EXALO MEDIA, available via telephone number 06-38278500, via info@exalo.nl (preference).

Vacancies and resumes

Article 12 Registration as an employer

If you register as an employer at Vendior website, you first request an activation code. You do this with your tax (VAT) number. This is necessary because EXALO MEDIA wants to check your identity before you can access the resumes on Vendior website.

When creating an account, it is mandatory to use an email address ending in a domain name on which your company website is also hosted. Addresses ending in e.g. Gmail.com, Hotmail.com or similar are not allowed.

A User only has access to the resumes on Vendior website if he is an employer and has registered as an employer on Vendior website. Only those employees of the employer who have an employment contract with the employer can register. This means that if the employment contract with the employer has ended, the access for that employee of the employer is no longer authorized. Access to the personal data of the (public) CVs is reserved to an employer or one of its employees who has successfully completed the application process. The responsibility lies with the employers.

Article 13 Use

The User will only use the CV and vacancy bank of Vendior website and the (personal) data provided therein for the placement of CVs and vacancies as well as the sending of emails to other Users exclusively aimed at fulfilling your active vacancy.

User will refrain from conduct that may cause EXALO MEDIA and / or other Users damage. This is in any case – but not exclusively – understood as follows:

  • Adjusting, deleting or rendering unusable data of other Users.
  • The unsolicited sending of e-mails to other Users that are not related to the placing of vacancies of the User or the making of applications.
  • Selecting and using any vacancies and / or data from other Users for purposes other than those described in the previous paragraph, possibly with resources.
  • Doing advertising.
  • Making political statements.
  • Making threatening, discriminatory, offensive and / or hurtful statements.
  • Acting in violation of any statutory regulation.

By placing a vacancy or a resume on Vendior’s CV and vacancy database, EXALO MEDIA employees are not automatically mediated for you. The vacancy or CV can be found by other Users on Vendior website.

Article 14 Vacancies

A vacancy, including the requirements stated in the vacancy, but also the selection by the employer of candidates for the vacancy, may not be in conflict with the provisions of the Equal Treatment Act, the Equal Treatment on the grounds of disability or chronic illness, the Equal treatment on the grounds of age in employment and the Equal Treatment of Men and Women Act.

Employer ensures that the vacancy, as well as the information provided by the employer, is correct, complete and not misleading. In any case, the following information will be included in the vacancy:

  • Job title
  • Nature of the work
  • Hours
  • Reward form
  • Nature of the employment
  • Starting date of the vacancy
  • Contact person and telephone number
  • Application method

Employer ensures that the vacancy is and remains up to date. When filling the vacancy or no longer making it available, the employer will remove the vacancy as soon as possible from Vendior website.

Each individual vacancy can only be placed once.

The employer may not attach any costs to the applicant for responding to a vacancy.

Article 15 CVs

User ensures that the information provided in his resume is accurate and not misleading.

User is responsible for the content of his resume and for keeping it up to date.

Article 16 Delete and refuse vacancy

EXALO MEDIA removes or refuses a vacancy if:

  • the (text of the) vacancy is in conflict with the provisions of these General Terms and Conditions;
  • in the opinion of EXALO MEDIA, the filling of the vacancy can damage the position of the job-seeker.

EXALO MEDIA removes the vacancy at the end of the term linked to the vacancy, unless the relevant User has requested a renewal of the term before the end of this period.

Article 17 Removal and refusal of resumes

EXALO MEDIA removes or refuses a resume if (the text of) the resume is in conflict with the provisions of these General Terms and Conditions;

EXALO MEDIA removes the CV at the end of the period linked to the CV, unless the relevant User has extended the term for the CV by the end of that period.

Article 18 Responsibility for the content of resumes and vacancies

EXALO MEDIA offers with the CV and vacancy bank of Vendior website to the User the possibility to place vacancies and resumes independently without the intervention of EXALO MEDIA. The relevant User is personally responsible for the content of the CVs and the vacancies. EXALO MEDIA tests the posted CVs and job openings marginally and will take action if possible in the event of any violations of the conditions in these General Terms and Conditions. EXALO MEDIA is not responsible and not liable for the content of the CVs and vacancies posted, nor for the further course of the application procedure.

EXALO MEDIA is not liable for the correctness and completeness of the content of vacancies and CVs placed on Vendior website. EXALO MEDIA is also not liable for the correctness and completeness of the data concerning the Users themselves.

The e-mail traffic between Users takes place at the expense and risk of the relevant User (s).

A User who has noticed a vacancy or CV in the VacancyBaan.nl job and vacancy database that conflicts with the conditions in these General Terms and Conditions for vacancies and CVs, is requested to notify EXALO MEDIA by e-mail.
